1. Acceptance of Terms

By accessing or using the ClearSpend mobile application and website, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Use of Service

ClearSpend provides a personal financial management tool that allows you to view your financial accounts, track spending, and analyze your financial habits. The service is provided "as is" and "as available" without any warranties of any kind.

3. Account Registration

To use certain features of the ClearSpend app, you may be required to register for an account. You agree to provide accurate and complete information during the registration process and to update such information to keep it accurate and current.

4. Financial Institution Accounts

When you connect your financial accounts to ClearSpend:

  • You authorize ClearSpend and our third-party service providers to access your financial accounts on your behalf.
  • You represent that you have the right to authorize access to these accounts.
  • You understand that account information from your financial institutions is obtained through Plaid, a third-party service, and is subject to their terms and conditions.
  • You acknowledge that ClearSpend does not store your financial institution login credentials.

5. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account login information.
  • All activities that occur under your account.
  • Ensuring that you exit from your account at the end of each session.
  • Notifying us immediately of any unauthorized use of your account or any other breach of security.

6. Intellectual Property

The ClearSpend application, its original content, features, and functionality are and will remain the exclusive property of ClearSpend and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

7. Subscription and Payments

ClearSpend offers subscription plans with different features and pricing:

  • Subscriptions are billed either monthly or annually, according to your selected plan.
  • Payment will be charged to your selected payment method at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • You can manage and cancel your subscription through your app store account settings.

8. Limitation of Liability

In no event shall ClearSpend, its directors, employees, partners, agents, suppliers, or affiliates be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of profits, revenue, data, or data use.
  • Any damages related to your access to or use of the service, including any errors or omissions in the content.
  • Financial decisions made based on the information provided through the service.

ClearSpend is a financial information and visualization tool, not a financial advisor. The information provided should not be considered financial advice.

9. Disclaimer

ClearSpend is not responsible for the accuracy of information provided by financial institutions or third-party services. The information displayed in the app is for informational purposes only and may not reflect the most current data from your financial institutions.

We do not guarantee that the service will be secure or free from bugs or viruses. You are responsible for configuring your technology to access the service and should use your own virus protection software.

10. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms of Service.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
